The contracting states of the European Patent Convention are currently in negotiating of a unified court for Patents. The Preparatory Committee is composed of all members of the contracting states with the aim of establishing a new court in order to have a common place of taking legal actions of infringements.
The Agreement was signed by 25 EU Member States on 19 February 2013 and is now in the process of getting ratified and implemented in the national laws. By so far France, Great Britain and Austria have ratified the agreement and in all other countries it is already being processed in the legislation route.
The first instance of the court will be in Paris and the appeal court in Luxembourg. Furthermore there will be thematically divisions in London and Munich. When the court is established it will be hearing cases regarding infringement of patents in all member states. This will give the opportunity to avoid having the same processes against the infringements in every country.
